Please read these terms carefully before using AFL Survival Pool.

1. Introduction

Welcome to AFL Survival Pool ("the Platform"), a web-based competition platform operated in Australia. By accessing or using the Platform, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Platform.

AFL Survival Pool provides an online competition where participants select one AFL team per round to win. Correct selections advance; incorrect selections result in elimination. The last participant(s) standing share the prize pool.

2. Eligibility

To use the Platform and participate in competitions, you must:

  • Be at least 18 years of age.
  • Be a resident of Australia or have a valid Australian postal address.
  • Have the legal capacity to enter into a binding agreement.
  • Not be excluded or self-excluded from any gambling or competition services.

We reserve the right to request proof of identity and age at any time. Accounts found to be operated by ineligible persons will be terminated and any associated entries or winnings forfeited.

3. Account Registration

To participate in competitions, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain and promptly update your account information to keep it accurate.
  • Keep your login credentials confidential and not share your account with others.
  • Accept responsibility for all activity that occurs under your account.
  • Maintain only one account per person. Duplicate accounts may be terminated.

You must notify us immediately if you become aware of any unauthorised use of your account.

4. Competition Rules

AFL Survival Pool competitions operate under the following general rules:

  • Each round, you must select one AFL team that you believe will win their match.
  • Selections must be submitted before the published deadline (Wednesday 11:59 PM AEST).
  • If your selected team wins, you survive to the next round. If they lose or draw, you are eliminated.
  • Failure to submit a selection before the deadline will result in automatic elimination.
  • The last participant(s) remaining win the competition.
  • Re-entry may be available in some competitions, subject to the competition's specific settings and an additional fee.
  • Individual competition rules may vary. The specific rules displayed on each competition page take precedence.

The Platform administrators reserve the right to make final decisions on any disputes regarding competition results or rule interpretations.

5. Payments & Fees

Competition entry requires payment of an entry fee. By making a payment, you acknowledge and agree:

  • Entry fees are set per competition and displayed clearly before payment.
  • Each entry fee is split into three components: a contribution to the prize pool, an administration fee, and a charity donation.
  • Payments are processed securely via third-party payment providers (Stripe, PayPal) or manually confirmed by an administrator for bank transfers or cash.
  • Entry fees are generally non-refundable once a competition has commenced, except at our sole discretion.
  • Re-entry fees (where available) contribute to the charity and administration portions only and do not increase the prize pool.

All prices are in Australian Dollars (AUD) unless otherwise stated.

6. Prize Pool & Payouts

Prize pool distribution is determined as follows:

  • The prize pool consists of the pool contribution portion of all entry fees collected for a competition.
  • If one participant remains, they receive the entire prize pool.
  • If multiple participants survive the final round, the prize pool is split evenly among all survivors.
  • Payouts will be processed within a reasonable timeframe after competition completion.
  • Winners are responsible for any tax obligations arising from their winnings under Australian law.

The Platform reserves the right to withhold payouts pending verification of identity and compliance with these Terms.

7. Charity Donations

A portion of every entry fee is donated to charity. By participating, you acknowledge:

  • The charity portion of your entry fee is allocated to a registered Australian charity selected for each competition.
  • Charity donations are non-refundable under any circumstances.
  • The Platform maintains full transparency of charity contributions, viewable on the Charity Transparency page.
  • The Platform does not guarantee any tax deductibility for the charity portion of entry fees. Consult your tax adviser.

8. User Conduct

When using the Platform, you agree not to:

  • Create multiple accounts or use another person's account.
  • Use automated tools, bots, or scripts to interact with the Platform.
  • Attempt to gain unauthorised access to other users' accounts or Platform systems.
  • Engage in any form of collusion, match-fixing, or fraudulent activity.
  • Harass, abuse, or threaten other users or Platform staff.
  • Upload or transmit any harmful, offensive, or illegal content.
  • Interfere with the proper functioning of the Platform.
  • Use the Platform for any purpose that violates applicable laws or regulations.

Violation of these rules may result in immediate account suspension or termination, forfeiture of entries and winnings, and potential legal action.

9. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, designs, software, and code, is the property of AFL Survival Pool or its licensors and is protected by Australian and international intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent. AFL team logos and names are the property of their respective clubs and the Australian Football League.

10. Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms.

By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy. We employ encryption and security measures to protect sensitive personal data.

11. Limitation of Liability

To the maximum extent permitted by Australian law:

  • The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
  • We do not guarantee that the Platform will be uninterrupted, error-free, or free of harmful components.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
  • Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the total entry fees you have paid in the preceding 12 months.
  • We are not responsible for any losses resulting from system failures, internet connectivity issues, or third-party service outages that may affect your ability to submit selections.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason including but not limited to:

  • Breach of these Terms or any competition-specific rules.
  • Fraudulent, abusive, or unlawful activity.
  • Providing false or misleading information.
  • Non-payment or payment disputes.

Upon termination, your right to access the Platform ceases immediately. Any outstanding entry fees are non-refundable, and any pending winnings may be forfeited at our discretion.

You may also request to close your account at any time by contacting us.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms on the Platform, with the "Last updated" date revised accordingly.

Your continued use of the Platform after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically. For material changes, we will make reasonable efforts to notify registered users via email or Platform notification.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria for the resolution of any disputes arising from these Terms or your use of the Platform.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
